STATEMENTS: Dover Police Issue Statement In Regards to Ongoing Kurt Busch investigation: Due to numerous media inquiries regarding a criminal investigation involving professional race car driver #41-Kurt Busch, the Dover Police Department has issued the following statement: The Dover Police Department can confirm that an investigation is being conducted based on an allegation of domestic assault that is alleged to have occurred in the City of Dover involving Mr. Busch. These allegations were brought to the Dover Police Department on Wednesday, November 5th at 2:00PM. At this time, the department is still investigating the victim's claims and will not have any further comment on this matter in order to preserve the integrity of the case. The Dover Police Department will release further information as it becomes available. The Rockingham Speedway has taken another step towards being a part of racing history as attorneys for track co-owners Andy Hillenburg , of Harrsburg, N.C., and Bill Silas, of Stuart, Fla., are due in Richmond County Superior Court later this month.
Attorneys David M. Schilli and Brian L. Church, represent the Salisbury bank Farmers and Merchants. The bankowns the note on the loan. According to court records, Hillenburg and Silas owed $4,532,796.23 as of Aug. 8. The parties are due in court at 2 p.m. Thursday, Sept. 25. Both Hillenburg and Silas, who together own Rockingham Racing Park LLC, were served on Aug. 28.
The speedway is situated on 244.24 acres. The land alone is valued at about $2.5 million.
According to court records, Smith is a member of the North Carolina Motor Sports Association and is familiar with any process that goes along with potential liquidation.

Hillenburg and Silas purchased the track for $4 million in 2007 from Speedway Motorsports Inc. at an auction that had fewer than 10 bidders. According to WRAL.com, North Carolina Motor Speedway merged with Penske Motorsports in 1997. The track was renamed North Carolina Speedway and held two NASCAR Nextel Cup races a year through 2003. In 2003, the speedway was sold to International Speedway Corporation. One of its Nextel Cup races was given to ISCs California Speedway. The track held its last race in 2004 before Hillenburg took over management.
In the interim, the speedway had been as a testing track and often a movie set. Scenes from Talladega Nights: The Ballad of Ricky Bobby and Days of Thunder were shot at the speedway.
The final blow to Hillenburgs efforts might have come in October 2013, when NASCARs Camping World Truck Series schedule was released sans Rockingham. One month earlier, NASCAR officials announced the the K&N Pro Series East series in November 2013 had been canceled.
In the news release, a NASCAR official provided a telling but vague description of what the Rockingham track lacked: The track failed to meet its obligations and we were forced to terminate the sanction agreement.
Details on what obligations were not met need were released.
In the book Rockingham Speedway , published in 2013 and written by Rick Houston and Bryan Hallman, the authors recounted the rich championship tradition of the speedway, which opened in 1965.
The legendary Curtis Turner made his return to NASCAR with a victory in the tracks inaugural event in 1965, while local favorite Benny Parsons clinched the 1973 championship here. A 1994 victory at Rockingham clinched that years NASCAR championship for Dale Earnhardt. It was his seventh title, tying Earnhardt with Richard Petty for most in the sports history.

The Southern 500 at Darlington (SC) Raceway will return to its traditional Labor Day weekend date when NASCAR announces the 2015 Sprint Cup schedule, perhaps as early as this weekend.
Atlanta Motor Speedway which has raced on Labor Day weekend since 2009 will have its lone Sprint Cup race weekend moved earlier in the season to week #2 Sunday, March 1, 2015.
One other notable change will be the Bristol spring weekend often plagued by weather issues in March, Bristol successfully lobbied for a later date, and will now hold its spring Cup race on Sunday, April 19, 2015.
Michael McCann says it best.....While Stewart is poised to avoid criminal charges, he may not be so fortunate with civil litigation. Wards family could sue Stewart for wrongful death, which refers to negligently causing the death of another. A successful wrongful death lawsuit could lead to millions of dollars in damages, particularly since wrongful death damages are largely contingent on the decedents age and loss of future earnings. Ward was only 20 years old and he seemed to have a promising and possibly lucrative future as a driver. The statute of limitations for a wrongful death lawsuit in New York is two years, meaning Wards family has until Aug. 9, 2016 to sue.
Wards family would need to convince a jury that Stewarts conduct was probably unreasonable and caused Wards death. Other drivers would be called to testify as experts and offer their views as to the reasonableness of Stewarts conduct. Stewart himself could also be called to testify. His ability to invoke the Fifth Amendment to avoid answering questions would depend on whether the questions asked of him require him to admit that he engaged in criminal conduct.
In his defense in a wrongful death lawsuit, Stewart could argue that Wards own conduct played a crucial role in his death. After all, Ward clearly accepted some degree of safety risk by leaving hisrace carafter it spun out of control. Drivers are discouraged from leaving theirrace carsduring races unless their own safety is imperiled. Ward only elevated this safety risk by trying to confront or incite Stewart as Stewartsrace carapproached on the track.
On the other hand, Ward exited his vehicle only after the caution flag was thrown and he must have had no expectation that Stewartsrace carwould hit him or he obviously would not have waved his hands at Stewart. Moreover, if it is true that Stewart could see Ward, Stewarts decision to drive so close to him and perhaps even increase his speed on the approach might prove damning in the minds of jurors. Expert testimony would prove crucial in an interpretive legal debate of what Stewart should have done.
Stewart, whose net worth reportedly exceeds $100 million, may try to avoid civil litigation by reaching an out-of-court settlement with Wards family. A settlement would constitute a contract between Stewart and Wards family where Stewart would agree to pay a significant amount of money in exchange for Wards family relinquishing any legal claims it may have against him. The settlement would likely be confidential and not contain any admission of wrongdoing. Given that a civil trial involving Stewart would attract headlines and remind the public of Wards death, Stewart would seem to have good reason to seek a settlement and avert a trial
